MyCondor Terms of use

§ 1 SCOPE

1.1 These conditions for use apply to the use of the MyCondor customer account by the user.

1.2 The provider and operator of MyCondor is Condor Flugdienst GmbH (”Condor”), An der Gehespitz 50, 63263 Neu-Isenburg.

1.3 These conditions for use apply exclusively. Conflicting or deviating terms and conditions of the user are not recognized unless Condor expressly agrees to their validity.


§ 2 REGISTRATION, CONTRACT CONCLUSION, SAVING OF THE CONTRACT TEXT AND CONTRACT LANGUAGE

2.1 The use of the MyCondor Customer account requires registration by the user and the set-up of a customer account. The provision of MyCondor is at no cost to the user.

2.2 The registration requires the input of a permanent e-mail address. Input of a so-called “throw-away address” that is only valid temporarily is expressly prohibited.

2.3 After the user sends the on-line registration form, Condor will send a confirmation e-mail to the indicated e-mail address with an activation code. The sending of this e-mail constitutes a offer by Condor to conclude a usage agreement on the use of MyCondor based on the Terms of Use. When you enter and confirm the activation code from the e-mail sent to you in the corresponding field, you accept this offer and thus the conclusion of the agreement. Once you have confirmed your registration with this code, your MyCondor customer account will be active.

2.4 The user's agreement to these Terms of Use is saved by Condor, but not accessible to the user. However, the user can view the data saved to their customer account in their customer profile on MyCondor. The user can also query the Terms of Use at any time, using the link “MyCondor Terms of Use” at condor.com, print them out or download or save them, but always only in the current version. Older versions will not be saved.

2.5 The contract can be concluded in German or in English.

2.6 To be able to use MyCondor, the user must be at least 16 years of age.
 

§ 3 ACCESS TO AND USE OF MYCONDOR

3.1 The offers on MyCondor are offered solely to the users who have entered into a contract for use. Persons who do not fulfil these conditions are not permitted to use MyCondor.

3.2 The evidence of authorization for use of MyCondor according to 3.1 is proven by entering an e-mail address and the individual password. The e-mail address and individual password may not be provided to third parties. In the event that a user becomes aware that a third party has access to their login details, they are obligated immediately change their login details. Condor reserves the right to take legal action in the event of unauthorized transfer and use.
 

§ 4 TERMINATION OF THE USER CONTRACT, DISCONTINUATION, LIMITATION OR CHANGE OF THE OFFER AND DELETION OF THE USER ACCOUNT

4.1 The user can end the user contract at any time without providing a reason by deleting the user account via the “Delete Account” function in MyCondor or to cancel the user contract by sending a written message to Condor (e-mail or letter) without heeding a deadline.

4.2 Condor is authorized to cancel, limit or change the cost-free provision of MyCondor at any time. In addition, Condor is authorized to cancel the user contract at any time by notifying the user in writing with a notice period of five days and to block access to the user account on MyCondor when the cancellation comes into effect.

4.3 If there are violations of the Terms of Use, in particular if minors under 16 years of age according to number 2.6 log into the account, Condor is authorized to immediately block the user account without notice and to cancel the user contract. Further claims by Condor remain unaffected.

4.4 The user account and its access rights to MyCondor are deleted after cancellation or termination.
 

§ 5 FINAL PROVISIONS

5.1 Condor has the right to change the Terms of Use at any time and without providing a reason. The user will be informed of the changed terms when they log in to MyCondor after the changes become effective. If the user accepts the new Terms of Use during login, the changed conditions become an integral part of the user contract. Condor will inform the user of the legal consequences of this in particular when notifying them of the new Terms of Use.

5.2 German law applies, with the exception of the UN Convention on the International Sale of Goods, even if the customer resides or has their headquarters abroad. This choice of law applies to users only to the extent that the protection of consumers is not divested by any obligatory conditions, meaning subject to contrary agreement of the country in which the user has their main residence.
